Best Practices and Model Contracts for Highway P3s

As an industry leader in public-private partnership (P3) advisory, IMG Rebel helped the U.S. Department of Transportation (USDOT) prepare model P3 contracts for highways including availability payment and toll concession contracts, and a best practices guide to implement highway P3s.

Moving ahead with model contracts
In light of the growing use of P3s as a mechanism for delivering complex highways, IMG Rebel is advising the USDOT’s Federal Highway Administration (FHWA) in drafting model P3 contracts. The preparation of model contracts and best practices is mandated by the latest federal transportation legislation, Moving Ahead for Progress in the 21st Century (MAP-21). IMG Rebel is helping draft contracts for the two major forms of highway P3s: availability payment and toll concession contracts.

Best practices
The best practices guide is intended to educate public agencies on practical implementation of P3s, including working with the private sector in the development, financing, construction, and operation of highway facilities.

Attracting private investment
IMG Rebel’s approach to the development of model contracts and best practices focused on protecting the interests of the traveling public, taxpayers, and public authorities - including state departments of transportation and local governments. While protecting these interests is important, attracting private investment in highways is also essential. In its advisory capacity, IMG Rebel brings vast domestic and international experience from advising both the public and private sectors on developing, structuring, financing, and negotiating P3 transactions. IMG Rebel began this assignment in mid-2013 and will support the USDOT through 2014.
